El curso analiza las normas internacionales del trabajo como recurso para fortalecer la jurisprudencia nacional en temas laborales. Proporciona también material didáctico y metodologías para promover la formación en este ámbito.

Who attends this course?

El curso se dirige a jueces y magistrados, en especial aquellos que tienen a su cargo la justicia laboral; abogados laboralistas; asesores jurídicos de organizaciones de empleadores y de trabajadores; y docentes de derecho.

What topics does this course cover?
  • Overview of the ILS system and its procedures, from international drafting to national application.
  • When and how domestic judges and lawyers can use international labour law.
  • The work of the ILO supervisory bodies and its relevance to domestic judges and lawyers.
  • Substance of ILS in selected areas: freedom of association and the right to collective bargaining, equality and non-discrimination in employment and occupation, termination of employment.
  • NORMLEX databases and ITCILO database on case law relying on ILS.
What will I learn?
  • In-depth knowledge of the instruments and supervisory machinery of the ILS system.
  • Capacity to use the analysis and pronouncements of the ILO supervisory bodies.
  • Capacity to determine when and how domestic judges and lawyers can use international labour law to solve labour disputes.
  • Capacity to identify and make use of ILS in key areas.
  • Capacity to use the databases on ILS and on case law relying on them.
How is the course organized?
  • One member of the Committee of Experts on the Application of Conventions and Recommendations, one of the main ILO bodies supervising the application of ILS by member States, among the resource persons.
  • Knowledge assessment at the start and at the end of the training. 
  • Practical approach with Internet demonstrations, case studies, role-plays and group discussions.
  • Synthesis exercise to draw practical conclusions on opportunities for the judicial use of international labour law at the national level.
